Terms of Service

01Acceptance of terms

By creating an account, accessing, or using the ScrapingIsNotACrime API ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

02Description of service

ScrapingIsNotACrime provides an HTTP API that retrieves publicly available data from social media platforms including Instagram, TikTok, and YouTube. The Service operates on a credit-based model β€” you purchase credits and consume them on a per-request basis.

Key point: The Service is designed exclusively for accessing data that is publicly accessible on the internet β€” content anyone can see without logging in. We do not bypass authentication, access private accounts, or circumvent platform access controls.

03Acceptable use

You may use the Service for any lawful purpose, including but not limited to:

  • Market research and competitive analysis
  • Brand monitoring and social listening
  • Academic and journalistic research on publicly available data
  • Building data pipelines, dashboards, and analytics products
  • Training machine learning models on public data
  • Content aggregation and curation tools
  • Influencer discovery and audience analysis

You are responsible for ensuring your use of the retrieved data complies with applicable laws in your jurisdiction.

04Prohibited use

You must not use the Service to:

  • Stalk, harass, or build surveillance tools targeting specific individuals
  • Compile data for spam, phishing, or unsolicited outreach campaigns
  • Attempt to access private, non-public, or login-gated content
  • Circumvent any platform's authentication or access controls
  • Resell API access, proxy our endpoints, or build a competing API service using our infrastructure
  • Collect data of minors for any commercial or profiling purpose
  • Use the Service in any way that violates applicable law, including data protection regulations (GDPR, CCPA, LGPD, etc.)
  • Automate bulk personal data harvesting for purposes of identity theft or fraud
Violation: Prohibited use will result in immediate account suspension and forfeiture of unused credits without refund. We may report egregious violations to relevant authorities.

05Credits & billing

  • 1 successful API request = 1 credit. Failed requests (4xx/5xx) are not charged.
  • Credits are purchased in advance and are non-refundable after use.
  • Unused credits do not expire.
  • All prices are in USD and exclusive of applicable taxes.
  • We reserve the right to change credit pricing with 30 days' notice to registered users.
  • Refunds for unused credits may be granted at our sole discretion within 14 days of purchase.
  • Chargebacks initiated without contacting us first will result in immediate account termination.

06API keys & account security

Your X-API-Key is a secret credential. You are solely responsible for:

  • Keeping your API key confidential β€” do not commit it to public repositories
  • All activity that occurs under your API key, whether authorized or not
  • Rotating your key immediately if you suspect it has been compromised

We will never ask for your API key via email or support channels. If a key is compromised, revoke it from your dashboard immediately and generate a new one. We are not liable for losses resulting from unauthorized key use.

07Service availability

We target 99.9% uptime but do not guarantee uninterrupted service. Downtime can result from scheduled maintenance, infrastructure failures, or upstream platform changes outside our control.

We will publish planned maintenance windows with at least 24 hours' notice on our status page. Credits consumed during a verified service outage will be refunded upon request.

08Intellectual property

The ScrapingIsNotACrime API, documentation, dashboard, and brand are owned by us and protected by intellectual property law. You may not copy, reverse-engineer, or create derivative works of our infrastructure.

Data retrieved through the Service may be subject to the intellectual property rights of the originating platform or content creator. You are responsible for ensuring your downstream use of retrieved data complies with applicable IP law and the terms of service of the source platform.

09Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The Service will be uninterrupted, timely, or error-free
  • Data retrieved will be accurate, complete, or current
  • The Service will meet your specific requirements
  • Any specific social media platform will remain accessible

10Limitation of liability

To the maximum extent permitted by law, ScrapingIsNotACrime and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claim under these Terms shall not exceed the total amount you paid for credits in the 90 days preceding the claim.

11Indemnification

You agree to defend, indemnify, and hold harmless ScrapingIsNotACrime from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your infringement of any third-party rights.

12Termination

You may terminate your account at any time from your dashboard settings. Upon termination, your API keys are immediately revoked.

We may suspend or terminate your account immediately, without notice, if we determine you have violated these Terms. On termination for cause, unused credits are forfeited. On voluntary termination, unused credits may be refunded at our discretion within 14 days.

13Governing law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall first be attempted to be resolved via good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration.

14Changes to terms

We may update these Terms at any time. Material changes will be communicated by email to registered users at least 14 days before taking effect. Continued use of the Service after that date constitutes acceptance.

Non-material changes (typos, formatting, clarifications) take effect immediately without notice.

We wrote these Terms to be honest and readable. If something feels ambiguous or unfair, email us β€” we'd rather fix it than have you agree to something you didn't fully understand.

We use privacy-respecting Google Analytics on our public pages only β€” never inside your dashboard β€” to understand traffic. It's off until you opt in, and you can change your mind anytime in the footer.
